Pittsburg Municipal Court Prosecutor’s Office Issues Notice Regarding Delta-8 THC Products

PITTSBURG, KS – February 18, 2025 – The Pittsburg Municipal Court Prosecutor’s Office is issuing a public reminder regarding the legality of Delta-8 THC products in Kansas.
In December 2021, the Kansas Attorney General’s Office issued Legal Opinion No. 2021-4, which clarified that Delta-8 THC, a cannabinoid commonly found in certain hemp products, is considered a Schedule I controlled substance in Kansas. This means Delta-8 THC is illegal to possess, distribute, or sell in the state, with one notable exception: it must be made from industrial hemp that contains no more than 0.3% total tetrahydrocannabinols (THC).
This opinion further outlines a range of prohibited hemp products, including but not limited to cigarettes, cigars, teas, edibles, substances intended for vaping, smokeless materials, and any hemp-derived products intended for human or animal consumption that violate Kansas’ Food, Drug, and Cosmetic Act or the Commercial Feeding Stuffs Act.

The Pittsburg Municipal Court Prosecutor’s Office has thoroughly reviewed the Attorney General’s legal opinion and concurs with the findings. As part of our efforts to ensure compliance with state law, notifications have been sent to local businesses that have previously been identified as marketing or selling Delta-8 THC products in violation of this legal opinion.
“We understand that the presence of illegally marketed substances in the marketplace can create confusion for consumers,” said John Mazurek, Pittsburg Municipal Court Prosecutor. “We hope that businesses and others involved in the sale of Delta-8 THC will take this opportunity to review the law and cease offering these prohibited products.”
Businesses and individuals who continue to possess or distribute Delta-8 THC products in violation of state law should be aware that the Pittsburg Municipal Court Prosecutor’s Office will review investigations and cases submitted for consideration. Charges may be filed in accordance with the laws of Kansas and the ordinances of the City of Pittsburg.
